Terms of Service

1.1. Welcome to MIRA ("we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of our web-based creative platform located at mira.ai (the "Service"), which combines client-side editing tools and server-side AI generation.

1.2. By registering for, accessing, or using the Service, you confirm that you have read, understood, and agree to be legally bound by these Terms. If you do not agree with these Terms, you must not use the Service.

1.3. Onboarding Acceptance: Upon first use of the app, you are required to review and accept our Community Guidelines through an onboarding process. Acceptance of these guidelines is mandatory to access the Service.

2.1. Generations: Any AI-created image or video returned by the Generative Service (including the "Projects" module) in response to your Prompt or Reference Image.

2.2. User Uploads: Images or videos you upload to the Service for AI processing.

2.3. Credits: Compute units used to utilize the Generative Service. Credits are purchased through Subscriptions or Credit Packs and are deducted when you run server-side AI generations. Credits never expire and remain valid until consumed.

2.5. Generative Service (AI Studio & Projects): The feature set operating server-side, utilizing AI models to create unique digital images or videos.

2.6. Subscription: A recurring payment plan (weekly or monthly) that provides regular credit allocations and access to Daily Streak Bonuses.

2.7. Credit Pack: A one-time purchase of a fixed quantity of Credits, delivered instantly upon payment.

2.8. Daily Streak Bonus: Bonus credits awarded to subscribers for consecutive daily engagement with the Service.

3.1. MIRA is a creative platform providing a Generative Service (Server-Side). This AI-powered feature set requires your Prompts and Reference Images to be sent to our servers for processing to generate digital media. This includes the "Projects" module (e.g., AI Product Photography, AI YouTube Thumbnails, AI UGC Video).

3.2. Scope of Service: The Core Editor supports file formats such as PNG and JPG. AI-generated video content is supported exclusively through the "Projects" module. References to non-AI video post-processing or frame-by-frame exports found in historic marketing materials are legacy content and do not form part of the current Service.

3.3. No Free AI Features: Access to the Generative Service requires Credits. We do not offer free AI generation features, free credits, or trial refreshes. All AI generation capabilities require paid Credits obtained through a Subscription or Credit Pack purchase.

4.1. Age Requirement: You must be at least 16 years old to register and use our Service. By using the Service, you confirm that you are 16 years of age or older.

4.2. Account Security: You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account.

5.1. Subscription Plans: We offer tiered subscription plans (Pro and Premium) with weekly or monthly billing cycles. Each plan includes a fixed credit allocation per billing period and access to Daily Streak Bonuses. Current plans include: Pro Weekly ($7.99/week, 2,250 credits), Pro Monthly ($24.99/month, 9,000 credits), Premium Weekly ($14.99/week, 4,000 credits), Premium Monthly ($44.99/month, 16,000 credits). Prices and allocations are subject to change.

5.2. Credit Delivery: Upon successful payment for a Subscription or Credit Pack, all Credits are delivered instantly to your account. Credits are non-transferable between accounts.

5.3. Credits Never Expire: All Credits in your account, whether obtained through Subscriptions or Credit Packs, never expire and remain valid until consumed.

5.4. Subscription Cancellation: You may cancel your Subscription at any time. Upon cancellation, your Subscription remains active until the end of your current billing period. All Credits in your account at the time of cancellation remain available for use and do not disappear.

5.5. Credit Packs (One-Time Purchases): Credit Packs are one-time purchases available in various quantities: 1,000 credits ($4.99), 5,000 credits ($19.99), 10,000 credits ($39.99), 15,000 credits ($59.99). Prices are subject to change.

5.6. Daily Streak Bonus: Active subscribers earn bonus credits for consecutive daily logins. Bonus amounts escalate over the first 7 days (50, 75, 100, 150, 200, 250, 300 credits) and continue at the maximum rate (300 credits/day) thereafter. Maximum potential bonus is approximately 8,025 credits in a 30-day month.

6.1. Ownership of Input (Your Content): You retain full ownership of all content (images/videos) you upload to the Projects module ("Your Content").

6.2. Reference Image Warranties: When using the Generative Service, you represent and warrant that you own the rights to the reference image provided or have explicit, non-infringing permission to use it.

6.3. Ownership of Generations: Subject to your full compliance with these Terms, you are granted the commercial rights to the Generations you create. This grant of rights is limited by and subject to the licensing terms of the underlying Third-Party AI Models used to create the Generation (Section 7.2).

6.4. Prohibited Uses - Restricted Content: You may NOT use the Service to create, upload, or share restricted mature content. Violation of this policy will result in immediate and permanent account suspension.

6.5. Prohibited Uses - General: You may not use the Service to create, upload, or share illegal, harmful, defamatory, exploitative, deceptive, or abusive content.

6.6. AI Safety & Content Moderation: We employ automated AI safety systems to screen uploaded Reference Images. a) We reserve the full and exclusive right to reject any uploaded content flagged as unsafe, inappropriate, or in violation of these Terms. b) We maintain a zero-tolerance policy for severe abuse and may use third-party technologies to detect and prevent harmful misuse. c) In severe cases, we reserve the right to report relevant activities and associated user data to appropriate authorities as required by law.

7.1. AI-Generated Content Transparency (EU AI Act): All Generations created by our Service are identified as artificially generated, typically via watermarks or embedded metadata. You agree not to remove any such watermarks or metadata.

7.2. Third-Party Models: We utilize third-party models (e.g., Sora, Flux, Google Veo). We do not guarantee the continued availability, output quality, or specific licensing terms of any particular model.

7.3. No Guarantee of Uniqueness: Due to the probabilistic nature of AI, we do not guarantee that your Generations will be unique.

8.1. Aesthetic Disagreement: AI generation is a creative and probabilistic process. If a generated output is technically functional but you are dissatisfied with the aesthetic style, this does not constitute a valid reason for a Credit refund.

8.2. Logically Broken Generations: If a Generation is "logically broken" (e.g., severe artifacting), you may report it using the in-app "Report" button. We review reports within 24 hours.

8.3. System Failures: If a generation fails due to a technical system error, the system is designed to automatically refund the Credits.

9.1. Payment Processor: All financial transactions (Subscriptions and Credit Packs) are processed securely via Stripe.

9.2. Subscription Billing: Subscriptions are billed on a recurring basis (weekly or monthly depending on your selected plan). You authorize us to charge your payment method on each billing date until you cancel.

9.3. Financial Refunds: Sales of Credit Packs and Subscription payments are final. Financial refunds are only considered for unresolved technical issues.

9.4. Right of Withdrawal (EU Consumers): By purchasing Credit Packs or Subscriptions, you consent to the immediate delivery of the digital content and acknowledge that you lose your statutory 14-day right of withdrawal.

10.1. Processing Scope: Server-Side (Generative Service) Prompts and Reference Images are sent to our servers.

10.2. Data Retention: Reference Images and generated outputs are stored on Cloudflare R2 and deleted automatically after 24 hours unless saved.

10.3. Third-Party Processors: We utilize Stripe for payment processing and Supabase for account management.

11.1. Temporary Suspension: We may temporarily suspend your account if we detect activity that potentially violates these Terms. Temporary suspensions may require manual review by our team before your account access is restored. During suspension, you cannot access the Service or use your Credits.

11.2. Permanent Termination: Your account will be permanently terminated without the possibility of reinstatement in cases of: (a) Critical violations including but not limited to CSAM, non-consensual intimate imagery, credible threats of violence, or other illegal content; (b) Deliberate and repeated violations of our content policies after prior warnings; (c) Attempts to circumvent our safety systems or exploit the Service.

11.3. Credit Forfeiture: Upon permanent account termination for Terms violations, all Credits in your account are forfeited. No refund will be issued for unused Credits or active Subscription periods. Forfeited Credits are retained by MIRA to offset the costs of internal investigation, content review, and platform safety measures.

11.4. Appeal Process: If you believe your account was suspended or terminated in error, you may contact support@mira.ai within 14 days of the action. We reserve the sole discretion to review and decide on appeals. Appeals for permanent terminations due to critical violations (as defined in 11.2) will not be considered.

11.5. Legal Reporting: In cases of suspected criminal activity, we will report the incident and provide relevant user data to law enforcement authorities without prior notice to the user.
